Version 1.0 · Effective: August 31, 2026 Product safety, prohibited products, restricted products, recalls, producer responsibility, and illegal goods
1. Purpose and scope
This Product Safety & Illegal Goods Policy governs Product safety, prohibited Products, restricted Products, illegal goods, recalls, Product Safety Information, Product Safety Contacts, Responsible Person information where required, producer-responsibility requirements, and safety-related listing eligibility on Jersium.
It applies when a User or Guest lists, offers, sells, buys, ships, receives, reports, uploads information about, or otherwise interacts with a physical Product through Jersium.
This Policy forms part of Jersium's Terms & Conditions and is the primary home for Jersium's product-safety and illegal-goods rules. It does not replace the Seller Terms, Buyer Terms & Buyer Protection Policy, Marketplace Terms, User Content Rules, Product Data Rules, IP, Copyright & Counterfeit Reporting Policy, or Privacy Policy where those documents govern their own subject matter. Mandatory legal rights always apply.
2. Key terms
Capitalised terms have the meanings given in the Terms of Service or the relevant Platform Policy unless this Policy states otherwise.
Product Safety Information means information, documents, photos, labels, warnings, instructions, manufacturer details, importer details, Product Safety Contact details, Responsible Person details where required, traceability information, batch or model information, material or composition information, and other information relating to Product safety, compliance, warnings, lawful supply, or safe use.
Product Safety Contact means the contact shown or provided for product-safety questions, safety notices, recall cooperation, market-surveillance communication, or another product-safety purpose.
Illegal Good means a Product that is illegal to list, offer, sell, buy, import, export, ship, possess, advertise, promote, or distribute in a relevant region, destination, transaction, or Platform context.
Prohibited Product means a Product or category that Jersium does not allow on the Platform, whether because it is illegal, unsafe, recalled, counterfeit, stolen, restricted by Jersium, a payment provider, a carrier, or customs rules, or otherwise unsuitable for Jersium.
Restricted Product means a Product or category that may be listed, sold, shipped, purchased, displayed, or used only where additional conditions are satisfied.
Recalled Product means a Product that has been recalled, withdrawn, banned, subject to a safety alert or corrective action, or otherwise identified as unsafe or non-compliant by a manufacturer, brand, Seller, authority, Jersium, or another relevant party.
3. Core product-safety rule
Users must not use Jersium to list, offer, sell, buy, request, upload, promote, disguise, ship, import, export, or otherwise facilitate unsafe, recalled, illegal, prohibited, non-compliant, mislabelled, or restricted Products.
Products listed or sold through Jersium must be lawful for the relevant transaction, safe for their normal or reasonably foreseeable use, and supported by the Product Safety Information required for the Product, Seller type, region, destination, and Platform flow.
Jersium may apply stricter rules than the legal minimum where necessary or useful for user safety, marketplace trust, payment compliance, carrier compliance, customs compliance, operational readiness, platform integrity, or legal risk management.
4. Seller-type responsibility
All Sellers, Private and Commercial, must not list, offer, sell, ship, or otherwise make available Products that are unsafe, recalled, illegal, prohibited, non-compliant, or restricted in a way that is not satisfied, and must describe the actual Product accurately, disclose known safety issues, recalls, and restrictions, use the correct listing fields, and respond to reasonable product-safety questions or Platform requests.
Additional legal duties depend on the Seller type, Product, region, destination, and transaction. A requirement that applies to a Commercial Seller does not automatically apply to a Private Seller unless mandatory law, this Policy, another Platform Policy, or the relevant Platform flow makes it applicable.
5. Private Sellers
Private Sellers must not list Products that they know, or should reasonably know from the information available to them, are unsafe, recalled, illegal, prohibited, counterfeit, stolen, or not allowed on Jersium, and must disclose known defects, damage, alterations, missing labels or warnings, unusual use limitations, recall information, or other safety-relevant facts a Buyer would reasonably consider important.
Jersium does not expect a Private Seller to create commercial-only product-compliance documents for an ordinary second-hand personal sale unless applicable law, the Product category, the destination, a safety concern, or the relevant Platform process requires specific information for that Product. Where a Private Seller cannot provide information reasonably needed to resolve a safety, recall, illegal-goods, counterfeit, customs, carrier, or compliance concern, Jersium may restrict, deactivate, block, cancel, or review the affected listing or transaction.
Private Sellers are exempt from the producer-responsibility requirements described later in this Policy.
6. Commercial Sellers
Commercial Sellers may have additional product-safety, consumer-protection, conformity, warning, labelling, traceability, Responsible Person, manufacturer, importer, documentation, corrective-action, recall, market-surveillance, and producer-responsibility obligations.
A Commercial Seller must ensure that each Product it lists, offers, sells, ships, or otherwise makes available through Jersium is lawful, safe, accurately described, and compliant with the product-safety requirements that apply to that Product, Seller, region, destination, and transaction.
Where required by law, category rules, seller setup, listing creation, checkout, support, or another Platform flow, a Commercial Seller must provide accurate Product Safety Information, including applicable warnings, labels, instructions, manufacturer information, importer information, Product Safety Contact information, Responsible Person information, and traceability information, and must keep it current.
Seller record-keeping, evidence, verification, payout, enforcement, and account consequences for missing or unreliable information are governed primarily by the Seller Terms and relevant Platform information.
7. Buyer safety review
Buyers should review the listing, Seller photos, Seller type, condition information, Product Safety Information, warnings, age or use limitations, care instructions, included items, and checkout information before completing a purchase and before using a Product.
If a Buyer believes a Product is unsafe, recalled, mislabelled, missing required warnings, non-compliant, or otherwise raises a product-safety concern, the Buyer should stop using the Product where appropriate and report the issue through Jersium support or reporting tools. Buyer-facing remedies are governed by the Buyer Terms & Buyer Protection Policy and mandatory law.
8. Prohibited Products and illegal goods
Prohibited Products and Illegal Goods are not allowed on Jersium, even if a User believes the Product is collectible, rare, historically interesting, lawful in another country, available on another platform, or capable of being shipped by a third party.
Examples may include Products that are unsafe, recalled, banned, stolen, counterfeit, unlawfully sourced, hazardous, age-restricted, controlled, subject to customs or carrier restrictions, outside Jersium's supported Product scope, or otherwise unsuitable for the Platform.
Current unsupported, prohibited, or restricted categories may be shown in listing creation, seller setup, checkout, category guidance, Help Centre pages, support messages, Product Data tools, or other Platform information. Jersium may reject or restrict a Product even if similar Products previously appeared on Jersium.
9. Stolen goods and organised retail crime
Stolen Products are prohibited on Jersium. Users must not knowingly list, offer, sell, purchase, facilitate, conceal, relist, or attempt to sell a Product that is stolen, unlawfully obtained, or offered without the legal right to sell it.
Anyone may report a Seller, listing, or Product they believe is or may be connected with stolen goods, including without a Jersium Account where the relevant reporting channel allows this.
Where a User knowingly deals in stolen goods or otherwise breaches this section, Jersium may preserve relevant records, request evidence of lawful sourcing, and restrict or suspend selling privileges or an Account, in addition to the actions available under this Policy generally. Jersium may use the information described in the Terms of Service's fraud-prevention rules, together with lawful-sourcing information and reports under this Policy, to prevent, identify, investigate, and respond to suspected stolen goods and organised retail crime.
Jersium provides timely, confidential cooperation to law-enforcement authorities regarding suspected stolen goods, organised retail crime, preservation requests, warrants, subpoenas, and other legal process, using the authority contact point in the Terms of Service, and responds in accordance with applicable law.
10. Restricted Products and additional checks
Some Products may require additional review, information, warnings, label photos, Product Safety Information, safety-contact details, Responsible Person information, producer-responsibility information, proof of lawful supply, customs eligibility, carrier eligibility, or other steps before they can be listed, displayed, purchased, shipped, or kept available.
Restricted-Product rules may depend on Product type, Product group, sport, age group, Seller type, Account type, region, destination, shipping method, Product Data status, safety status, legal status, evidence status, or other criteria shown on the Platform or used by Jersium. If a required condition is not satisfied, Jersium may keep the Product unavailable, restrict the listing, block checkout, request more information, or take another action.
11. Product Safety Information
Product Safety Information must be accurate, complete where required, current, and not misleading. A Seller must not use Product Safety Information, photos, labels, warnings, instructions, Product Data, category choices, or seller-added text to hide a safety issue, disguise an illegal Product, imply unsupported approval, or make a Product appear eligible where it is not.
Jersium may require Product Safety Information before or after a listing becomes visible, before checkout, after a report, during a dispute, after a sale, or where Jersium identifies a safety, legal, customs, carrier, payment, or platform-integrity concern.
12. Recalls, safety alerts, and corrective actions
Users must not list, sell, ship, or promote Recalled Products unless Jersium expressly allows a specific corrective-action or support process and the Product is lawful and safe for the relevant purpose.
If a Seller becomes aware that a listed, sold, or shipped Product is recalled, unsafe, subject to a safety alert or corrective action, or otherwise not compliant, the Seller must promptly inform Jersium through the relevant support or Seller process. Commercial Sellers may have separate legal duties to notify Buyers, authorities, manufacturers, importers, Responsible Persons, or other parties, and to cooperate with corrective actions; this Policy does not replace those duties.
Where Jersium becomes aware, including through an official safety alert, that a Product sold through Jersium is dangerous or recalled, Jersium may remove or restrict the affected listings, block checkout, request Seller cooperation, and take the other actions described in this Policy and the applicable Platform Policies. Jersium will notify affected Buyers where required by applicable law and may also notify them in other appropriate cases. Where a notification is required, Jersium provides the safety or recall information and available remedy information required by law.
13. Producer responsibility (packaging and textiles)
Scope: Commercial Sellers only. Private Sellers are exempt from this section.
Commercial Sellers are solely responsible for complying with extended-producer-responsibility, packaging, textile, waste, take-back, registration, reporting, labelling, and eco-contribution obligations that apply to them in every country they ship to, including registering with the competent producer registers or schemes and paying the applicable contributions, and, where required, appointing an authorised representative in the destination country.
Certain destination countries require sellers to hold, declare, or evidence producer-responsibility registrations before goods may be sold or shipped there, and in some of those countries Jersium is legally required to verify the registration before enabling the destination. Where that is the case, Jersium enables the relevant ship-to destination for a Commercial Seller only once the required registration information has been provided and, where applicable, verified. The destinations concerned, the information required, and the verification method are shown in seller setup and the relevant Platform information, and may change as legal requirements develop.
Commercial Sellers must keep their producer-responsibility information accurate and current, and must provide registration evidence on request. Jersium may suspend listings, disable ship-to destinations, block checkout, delay payouts where permitted, or restrict selling where producer-responsibility requirements are not met, where provided information is invalid, expired, or unverifiable, or where an authority requires it.
14. Regional, shipping, customs, and payment limits
A Product may be blocked or restricted because of region, destination, shipping route, carrier rules, customs rules, payment-provider rules, tax rules, product-safety or producer-responsibility requirements, or Platform availability. Sellers must not use workarounds to bypass Jersium's regional, currency, payment, product-safety, customs, carrier, or shipping restrictions. Detailed marketplace region, checkout, shipping, currency, and transaction rules are governed by the Marketplace Terms, Seller Terms, Buyer Terms & Buyer Protection Policy, Fee Table, and relevant Platform information.
15. Product Data, listing tools, and sample images
A Product Data Entry, sample image, listing template, suggested field, category structure, search result, Digital Collection entry, E-VER record, or checkout availability is not confirmation that a Product is lawful, safe, compliant, genuine, authorised, sellable, shippable, importable, exportable, or eligible for a particular Buyer or region. Sellers remain responsible for the actual Product they list. Detailed Product Data rules are governed by the Product Data Rules.
16. Counterfeit, IP, and lawful-sourcing overlap
Counterfeit, stolen, fraudulently obtained, infringing, or unlawfully sourced Products are not allowed on Jersium. A counterfeit, infringing, or unlawfully sourced Product may also create product-safety, customs, consumer-protection, payment, fraud, or illegal-goods concerns; Jersium may treat the same Product or activity under the Platform Policy that best fits the issue. Rights-holder reporting is governed by the IP, Copyright & Counterfeit Reporting Policy; transaction-specific authenticity claims between a Buyer and Seller are governed by the Buyer Terms & Buyer Protection Policy.
17. User Content, promotion, and circumvention
Users must not use listings, photos, Product comments, profile text, chats, reviews, hashtags, Product Data corrections, support messages, reports, or other Platform features to promote, request, disguise, facilitate, relist, repackage, reclassify, or coordinate unsafe, recalled, illegal, prohibited, deceptive, counterfeit, or restricted Products, and must not attempt to bypass this Policy by changing categories, hiding Product details, omitting safety information, using code words, moving communications off-platform, splitting transactions, bundling Products, creating new accounts, changing Seller identity, or changing shipping routes.
18. Cooperation with authorities and safety-alert systems
Jersium cooperates with market-surveillance, product-safety, customs, and consumer-protection authorities. Jersium maintains a product-safety point of contact for authorities and for users (see the contact points in the Terms of Service), registers with and monitors the official safety-alert systems applicable to its markets, and acts on official notices concerning dangerous products offered through the Platform — including removing or disabling access to the affected listings promptly within the period required by applicable law, informing affected Buyers where required, and providing the information and cooperation that authorities are entitled to request.
Jersium may also act on credible safety information from manufacturers, brands, rights holders, testing bodies, or users, without waiting for an official notice.
19. Reports and Jersium action
Jersium may receive or review reports about product safety, illegal goods, restricted Products, recalls, customs issues, carrier issues, counterfeit issues, producer-responsibility issues, or related compliance concerns through support, reporting, seller-compliance, marketplace, User Content, Product Data, Buyer Protection, or authority-request processes.
Jersium may request information, restrict a Product, deactivate a listing, block checkout, cancel or review an affected transaction, notify affected Users, refer the issue to another Platform process, or take another action permitted by Platform Policies or applicable law. The detailed process, notice, review, record-keeping, retention, cooperation, account, payout, Buyer Protection, moderation, and remedy consequences are governed by the Platform Policy and Platform information that apply to the affected feature or issue.
20. No legal advice or approval guarantee
Jersium may provide Platform information, category guidance, Product Safety Information fields, suggested contacts, listing guidance, safety warnings, compliance prompts, report flows, Help Centre content, or support messages, but this does not constitute legal advice. Jersium does not guarantee that a Product is lawful, safe, compliant, authentic, correctly labelled, or eligible for sale, shipment, import, or export merely because it appears on the Platform or passes a Platform flow.
21. Changes to this Policy
Jersium may update this Policy, and may change Product categories, restricted categories, Product Safety Information fields, safety-check processes, evidence requirements, report flows, warning requirements, listing controls, checkout controls, regional availability, shipping controls, recall processes, producer-responsibility fields, and related Platform information, where necessary or useful for product safety, legal compliance, regulatory guidance, authority requests, payment-provider requirements, carrier requirements, customs requirements, fraud prevention, marketplace integrity, operational readiness, or Platform development.
Notice of changes is given in accordance with the Terms of Service.
