Version 1.0 · Effective: August 31, 2026 Intellectual property, copyright, trademark, brand-rights, counterfeit, and rights-holder reports
1. Purpose and scope
This Policy governs how Jersium receives and handles reports concerning suspected intellectual-property infringement, copyright infringement, trademark or brand-right misuse, counterfeit Products, and related rights-holder concerns.
It applies to Users, Guests, Sellers, Buyers, rights holders, authorised representatives, and other persons who submit, receive, respond to, or are affected by an IP, copyright, trademark, brand-right, counterfeit, or similar report connected with Jersium.
This Policy forms part of Jersium's Terms & Conditions and is the primary home for IP and counterfeit-report handling by rights holders and third parties. A Buyer's claim that the specific item they purchased is not authentic is a transaction matter and is handled under the Buyer Terms & Buyer Protection Policy, as explained further below. Mandatory legal rights always apply.
2. Key terms
Capitalised terms have the meanings given in the Terms of Service or the relevant Platform Policy unless this Policy states otherwise.
Rights Holder means a person or organisation that owns, controls, or is authorised to enforce a copyright, trademark, brand right, design right, image right, database right, publicity right, or other protected right.
IP Report means a report, notice, complaint, rights-holder notice, counterfeit report, DMCA notice, counter-notice, or similar communication submitted under or connected with this Policy.
Reported Material means the listing, Product, User Content, Product and Collection Materials, photo, video, text, profile content, message, Product Data correction, Digital Collection material, E-VER material, or other Platform material identified in an IP Report.
Counterfeit Product means a Product that is alleged to misuse a protected trademark, brand sign, logo, crest, trade dress, label, tag, certificate, packaging, or similar identifier in a way that falsely suggests that the Product is genuine, authorised, licensed, official, or lawfully sourced.
Affected User means a User whose listing, content, Product, account, or Platform access is affected by an IP Report or action taken under this Policy.
3. Jersium's position on IP, brands, and counterfeit Products
Jersium respects copyright, trademarks, brand rights, design rights, image rights, database rights, publicity rights, and other protected rights. Users must not use Jersium to list, sell, promote, display, upload, distribute, or misrepresent counterfeit Products, infringing content, fake proof materials, fake authenticity documents, manipulated labels, unauthorised replicas, or other materials that misuse protected rights.
Jersium may allow accurate referential use of club names, league names, player names, brand names, product names, competition names, and similar identifiers where that use is relevant, non-misleading, and permitted by applicable law and Platform Policies. Jersium is an independent platform and does not imply affiliation, sponsorship, endorsement, or authorisation unless expressly stated.
Jersium does not authenticate items. No Product Data Entry, listing field, Digital Collection entry, E-VER outcome, Buyer Protection outcome, support outcome, or Platform display is an authentication, certification, appraisal, or expert determination that a Product is genuine, authorised, licensed, legally owned, lawfully sourced, non-infringing, or safe to sell. Decisions under this Policy and under Buyer Protection determine platform outcomes only.
4. What may be reported under this Policy
This Policy covers reports concerning suspected: copyright infringement, including unauthorised use of photos, images, graphics, text, or videos; trademark or brand-right misuse, including unauthorised use of protected names, logos, crests, trade dress, labels, tags, packaging, or branding; counterfeit Products or listings that falsely suggest a Product is genuine, official, licensed, match-worn, player-issued, autographed, authenticated, or otherwise authorised; misleading Product or collection materials using fake proof, fake certificates, or manipulated photos; and repeat infringement, repeat counterfeit activity, or misuse of IP reporting processes.
Where a report raises both IP and non-IP issues, Jersium may handle the relevant parts through the applicable Platform process.
5. Reporting channels and notice quality
Current reporting channels, forms, contact points, and operational instructions are shown in Platform information, including the Legal area, Help Centre, listing tools, and support tools. Reports may also be submitted by persons without a Jersium account.
A report must contain enough information for Jersium to identify the Reported Material, understand the right or counterfeit concern, and assess whether the reporter appears authorised to submit the report where authority matters. Jersium will confirm receipt where the reporter's contact details are available and will inform the reporter of the outcome where required by applicable law.
Jersium may request additional information before acting on a report that is incomplete, unclear, unsupported, misrouted, or abusive, and may update reporting channels, forms, and required fields through Platform information, provided mandatory legal requirements are met.
6. Buyer authenticity claims — where they go
A Buyer who believes that the specific item they received is counterfeit or otherwise not genuine should use the problem-report process in their order, which is governed by the Buyer Terms & Buyer Protection Policy, including its evidence requirements, deadlines, the applicable authenticity-claim window, and the available remedy. That process decides whether a Buyer Protection remedy is granted; it does not determine authenticity.
A Rights Holder or other third party who believes that a listing or Product on Jersium infringes their rights or is counterfeit should report under this Policy. Jersium may use information from either process in the other where relevant, and may take listing or account action based on either.
7. Trademark, brand-right, and counterfeit reports
A trademark, brand-right, or counterfeit report should identify the protected sign, brand, logo, crest, trade dress, label, tag, packaging, certificate, or other brand material concerned and explain why the Reported Material is alleged to be unauthorised, misleading, counterfeit, or otherwise infringing.
Where a report concerns a physical Product, Jersium may consider listing information, seller materials, Product photos, visible labels, packaging, proof materials, Seller history, Buyer reports, transaction information, rights-holder evidence, and other information available through the relevant Platform process.
Jersium may treat a counterfeit concern as an IP issue, a marketplace-integrity issue, a safety issue, or more than one of those. Transaction remedies and seller consequences are handled through the applicable marketplace, buyer, seller, or support process.
8. Copyright reports and DMCA notices
A copyright report should identify the copyrighted work and the Reported Material alleged to use it without authorisation.
If a copyright notice is intended to comply with the United States Digital Millennium Copyright Act, the notice must be sent through the designated copyright channel or agent shown in Platform information and must satisfy the requirements of the applicable DMCA process. Where Jersium receives a copyright notice that appears to require action under the DMCA or another applicable copyright process, Jersium may remove or disable access to the Reported Material, notify the Affected User where appropriate, and process any counter-notice where applicable.
9. Review, outcomes, notices, and review of decisions
Jersium reviews IP Reports for Platform purposes. Jersium is not a court, customs authority, professional authentication body, valuation service, or final legal adjudicator of intellectual-property ownership, infringement, authenticity, title, lawful acquisition, or lawful resale.
Depending on the report, evidence, applicable law, and Platform rules, Jersium may remove, disable, restrict, reinstate, relabel, de-index, hide, correct, or keep available Reported Material; request information from a reporter, Seller, Buyer, uploader, or Rights Holder; restrict listing or checkout availability; or apply another outcome. Jersium may act quickly where a report or available evidence indicates a credible counterfeit, infringement, fraud, safety, legal, payment, customs, or platform-integrity concern.
An Affected User may be asked or allowed to provide a response, correction, licence evidence, authorisation evidence, lawful-reference explanation, authenticity evidence, lawful-sourcing evidence, or other counter-information. Responses must be accurate and in good faith; fake authorisations, fake certificates, manipulated photos, false sourcing evidence, or misleading legal claims are prohibited. Where a DMCA counter-notice process applies, it must satisfy the requirements of that process.
Where action taken under this Policy is a Moderation Action, the Affected User receives a moderation notice and may request review under the User Content Rules, together with any additional rights described there.
10. Enforcement against infringement and counterfeit activity
Jersium does not wait for repetition where a violation warrants action: a single infringement — in particular listing a counterfeit Product or submitting fake proof — may itself result in any of the actions described in this Policy, including immediate restriction of listings, selling access, or the Account.
Jersium may restrict, suspend, or close Accounts, selling access, listings, content features, reporting features, or other Platform access where a User infringes rights, lists or promotes counterfeit Products, submits fake proof, misuses protected brands, or abuses IP reporting or counter-notice processes; repeated or coordinated activity results in stronger or longer-lasting action.
For copyright purposes, Jersium maintains and reasonably implements a policy for terminating, in appropriate circumstances, Users who are repeat infringers, and accommodates standard technical measures where applicable law requires it.
There are no automatic numeric thresholds. Jersium considers valid reports, credible rights-holder information, upheld Buyer Protection authenticity outcomes, Seller history, content history, repeated relisting attempts, Account links, previous warnings, and other relevant information, and decides Account consequences through manual review, with reasons and a review route as described in the User Content Rules. Immediate restriction remains available where counterfeit risk warrants it.
11. False, abusive, or bad-faith reports
IP Reports, copyright notices, counterfeit reports, and counter-notices must be submitted in good faith. Reporting tools must not be used to harass others, suppress lawful competition, remove legitimate listings, interfere with transactions, expose private information, pressure a User, or submit false or misleading information.
Jersium may reject, deprioritise, restrict, or take action in relation to reports, reporters, Users, Sellers, or accounts where reporting or counter-notice behaviour appears false, abusive, repetitive, automated, retaliatory, or misleading. A reporter may be legally responsible for false or misleading notices, including where applicable law provides remedies for misrepresentation in a notice or counter-notice.
12. Product Data, E-VER, and marketplace materials
Jersium may use Product Data, E-VER materials, Digital Collection materials, listing photos, seller proof materials, Buyer reports, transaction records, and other available Platform information to help review IP or counterfeit concerns. Those materials do not by themselves prove authenticity, legal ownership, lawful acquisition, authorisation, non-infringement, or lawful resale.
13. Updates to this Policy
Jersium may update this Policy as Platform features, legal requirements, reporting channels, marketplace regions, Product categories, or review processes develop. Current operational details, contact channels, forms, and Help Centre guidance may be shown in Platform information. Notice of changes is given in accordance with the Terms of Service.
