Version 1.0 · Effective: August 31, 2026
1. Purpose and scope
These Marketplace Terms govern marketplace transactions on Jersium: checkout, order formation, regional availability, currencies, payment processing, the shipping framework, taxes, and marketplace records. They apply to Users and Guests who browse, buy, sell, list, pay for, or otherwise participate in marketplace transactions. They form part of Jersium's Terms & Conditions; the Terms of Service explain how the Terms & Conditions and Platform information work together, and capitalised terms have the meanings given there unless these Marketplace Terms state otherwise. Mandatory legal rights always apply.
2. Jersium's marketplace role
Jersium operates a multi-vendor marketplace connecting Buyers and Sellers. Unless expressly stated otherwise, the sales contract for a Product listed by a third-party Seller is formed directly between the Buyer and the Seller; Jersium is not the seller, importer, or fulfilment service provider of third-party Products and is not a party to that sales contract. Every listing, checkout, order confirmation, and invoice identifies the third-party Seller.
Jersium separately provides marketplace services to Buyers (marketplace access, checkout, payment support, Buyer Protection, dispute support) and to Sellers (marketplace access, listing tools, payment support, order tools, seller services). Where Jersium sells its own Items — Jersium Store Items, E-VER services, digital products, vouchers — Jersium is the seller or provider for that Item, under the applicable checkout terms and feature terms.
A marketplace purchase therefore involves up to three relationships: Buyer↔Seller (the sales contract), Buyer↔Jersium (marketplace services), and Seller↔Jersium (seller services). Nothing in these terms limits mandatory rights in any of them.
3. Marketplace regions, currencies, and ship-to destinations
Jersium may limit marketplace search visibility, selling, purchasing, ship-to destinations, currencies, and checkout eligibility by region as part of its compliance, tax, product-safety, producer-responsibility, payment, logistics, and operational structure. A Seller's selling region follows their registered marketplace region and setup; a Buyer's shopping region and currency follow their ship-to selection and settings. Transactions are currently supported within each marketplace region (EU, UK, US); current supported regions, currencies, destinations, and any cross-regional availability are shown on the Regions page, seller setup, and checkout. Jersium may change regional availability as requirements develop, with notice under the Terms of Service where changes are adverse and material.
4. Regional selling and buying rules
Buying and selling are available only where Jersium enables the relevant Seller region, Buyer region, destination, currency, Product category, and checkout flow. Viewing a profile or listing does not mean the Product is purchasable in your region, currency, or destination; listings may be hidden or unavailable where the combination is not supported. Sellers must not sell or ship to destinations not enabled for them; Jersium may block checkout, update carts, hide or deactivate listings, or restrict accounts where these rules are not satisfied.
5. Currencies and conversion
Selling and shopping currencies are made available through Platform rules, seller setup, buyer settings, and payment-provider availability. If a selected currency or destination is not accepted for an Item, checkout is blocked until the Buyer changes settings or removes the Item. Where Jersium displays converted amounts, it may use official, central-bank, payment-provider, or reputable third-party exchange rates; conversions may be delayed, rounded, or indicative, and banks and card issuers may apply their own rates and charges. Where Polish law requires conversion into PLN for VAT purposes, Jersium uses the rate required or permitted by Polish tax rules. Final prices, taxes, and charges are shown before purchase where legally required.
6. Product Data Index and indexed products
Products may need to be indexed, classified, imaged, and released before they can be listed or used in marketplace features. Sellers must use Jersium's Product Data and listing tools; sample images identify products, and Seller photos show the actual Product. Jersium may correct Product Data and, where a correction materially affects a live listing, update, deactivate, or require review of it. Detailed rules: Product Data Rules.
7. Cart and checkout
Adding an Item to the cart does not reserve it; an Order is placed only after successful checkout with authorised payment. Jersium may limit Sellers, Items, quantities, or value per cart or Order, and may update carts where availability, settings, regional rules, or eligibility change. Buyers cannot buy their own listings. Before the Order is placed, checkout displays the information required for the transaction: Product price, selected extras, shipping costs, applicable taxes, total price, Seller identity and type, destination, payment method, delivery estimate, return information, and Buyer Protection information, as applicable. Buyers are responsible for reviewing checkout information and keeping address, contact, and payment details accurate. Jersium does not charge Buyers a marketplace fee; Seller fees are governed by the Seller Terms and Fee Table.
8. Search results and ranking
Unless a different sorting option is selected, marketplace search results are ordered by total price (Product price plus standard shipping to the selected destination), lowest first. Users can change the sorting at any time using the available options, such as Product price (lowest or highest first), condition (best first), Marketplace Performance (highest first), and, where available, dispatch time (fastest first). Which listings appear may additionally be limited by region, destination, currency, filters, availability, and the compliance rules in these terms.
Jersium may offer Sellers sponsored or promoted placements. Sponsored placements are clearly labelled, and their position may be influenced by the remuneration paid by the Seller; sponsorship does not alter the underlying search results and never overrides compliance or eligibility rules.
9. Order formation
For third-party Products, a Buyer places an Order by completing checkout and paying through the available payment method; the sales contract between Buyer and Seller is formed when the Order is accepted per the checkout flow and confirmation shown. The Seller is responsible for fulfilling it. For Jersium Store Items and services, the contract forms with Jersium per the relevant checkout terms. Jersium may refuse, cancel, delay, or review Orders where required by payment checks, fraud prevention, regional restrictions, tax or product-safety rules, sanctions, verification, technical or pricing errors, risk controls, or Platform Policies.
10. Order confirmation and records
After a successful Order, Jersium provides an order confirmation by email containing key transaction information and makes an immutable Order Summary available on the Platform. The Order Summary preserves the transaction-specific listing and checkout information, fees, Seller-specific conditions, and transaction-specific deadlines applicable when the Order was placed. Those transaction-specific terms remain applicable to that Order unless mandatory law requires otherwise, a later change is more favourable to the affected User, or a legal or safety intervention requires a different result.
For purchases from Commercial Sellers by EU or UK consumers, Jersium provides the statutory pre-contractual and withdrawal information, including the model withdrawal form, as required by applicable law. The confirmation does not replace any invoice a Seller must issue. Transaction records may include the Transaction ID, dates, parties, Product details, prices, taxes, currency, refund and payout information, and other marketplace data. Jersium issues its own invoices and corrective invoices for Jersium fees and services as described in the Seller Terms and Digital Services Terms. Order confirmation does not prevent later cancellation, refund, or review where required by payment failure, fraud checks, unavailability, legal compliance, or Platform Policies.
11. Payment processing
Payments are processed by one or more licensed or authorised third-party payment service providers and their banking and settlement partners. Funds are held and transferred by those providers and partners and are not held in Jersium's own accounts. Holding of funds, refunds, and Seller payouts are executed by the provider under the applicable Platform Policies. Available payment methods are shown at checkout and vary by region, currency, device, provider, and risk checks; Jersium may add, remove, or change methods and providers. Payment approval, authentication (including Strong Customer Authentication), settlement, refunds, and chargebacks are subject to provider, card-scheme, and bank rules and applicable law. Saved payment methods use provider tokenisation; Jersium does not store full card numbers. Jersium may refuse or delay a transaction where payment is declined, authentication fails, fraud checks are unsatisfied, or processing is restricted. Holding, release, delay, and recovery of Seller proceeds are governed by the Seller Terms.
12. Shipping framework
Every shipment must include tracking; Sellers must enter accurate tracking within the applicable shipping deadline shown on the order. Shipping options, fees, destinations, sales extras, and processing times are configured per Seller settings and Platform rules; where several extras are selected, only the longest additional processing time applies, within the ceiling shown. Jersium uses shipment data to display progress, estimate delivery, support Buyer Protection, release or delay proceeds, review delivery issues, and resolve disputes. Shipping deadlines are set in hours from payment authorisation and differ by Seller type; within that framework, the ship-by date on a Commercial Seller's order may be moved once, up to the maximum window shown for the order, which in turn may adjust the delivery estimate. Delivery estimates are estimates only; Jersium is not a carrier and does not control carrier performance or data. Detailed buyer- and seller-side rules: Buyer Terms & Buyer Protection Policy; Seller Terms.
13. Taxes
Prices and tax treatment vary by region, Seller type, locations, Item type, and applicable law; where required, taxes are calculated, collected, reported, remitted, or displayed at checkout based on transaction information. Where required by US state law, Jersium acts as a marketplace facilitator: it calculates, collects, and remits applicable sales or use tax on marketplace transactions, shows it at checkout, and Sellers are not responsible for the facilitated tax on those transactions. In other cases, tax law may treat Jersium as an online marketplace, electronic interface, deemed supplier, or similar operator for certain transactions; where such rules apply, Jersium may collect, withhold, report, remit, adjust, or document taxes accordingly, which may affect checkout display, invoices, records, proceeds, and refunds. Any such treatment applies for tax, reporting, compliance, and invoicing purposes only and does not by itself make Jersium the seller of a third-party Product for product-quality, product-safety, delivery, warranty, authenticity, conformity, or sales-contract purposes, except where mandatory law requires otherwise. Sellers remain responsible for their own tax obligations except where Jersium is legally responsible for a specific obligation. Jersium does not provide tax advice.
14. Customs and import charges
Customs charges, import taxes, duties, or carrier handling fees may apply depending on the transaction, locations, destination, Product, and applicable law — including for destinations with special customs or VAT status within a marketplace region. These charges are determined by the competent authorities and the carriers involved. Jersium does not know, calculate, display, collect, or remit them, and cannot state their amount in advance. Where an Order would ship from outside the Buyer's customs territory, Jersium may show a notice that additional charges may apply. Any such charges are payable by the Buyer, usually to the carrier or the authorities on or after delivery, and are separate from the amount paid at checkout. Jersium may update how it presents customs information as routes and legal requirements change.
15. Jersium Store Items and digital products
Jersium may sell its own Items — E-VER vouchers and services, digital products, JMS items, digital rewards, collector packs, profile features — under the Digital Services Terms, Digital Rewards Terms, checkout terms, and Platform information. Marketplace checkout, payment, record, tax-display, and error-correction rules apply to Jersium Store Items where relevant.
16. Errors, availability, and corrections
Jersium may correct errors, update transaction or Product Data, adjust order records, correct obvious pricing, tax, or fee errors, update availability, or cancel affected transactions where permitted by law and necessary to protect users, comply with law, or preserve marketplace integrity. If an error materially affects a purchase, Jersium may contact the affected User, cancel and refund, request confirmation, or deactivate the listing. Jersium is not required to honour obvious mistakes, technical errors, unauthorised listings, or fraudulent transactions, except where mandatory law requires otherwise.
17. Enforcement in marketplace transactions
Jersium may take action where a party, Product, listing, Order, payment, shipment, or transaction appears to violate Platform Policies, create risk, or breach law — including cart updates, checkout blocking, payment refusal, purchase or selling restrictions, listing deactivation, order cancellation, refund issuance, proceeds withholding through the payment provider, Marketplace Performance updates, Buyer Protection decisions, and account action — considering transaction evidence, tracking, reports, chats, history, risk, and applicable law. Fraud-prevention rules: Terms of Service. Moderation notices and review: User Content Rules.
18. Changes
Jersium may change marketplace rules, regional availability, currencies, shipping routes, payment methods, product categories, checkout rules, tracking tools, and tax logic where necessary for operational, legal, tax, payment, product-safety, security, compliance, or business reasons. Notice of adverse changes is given in accordance with the Terms of Service.
