Version 1.0 · Effective: August 31, 2026
1. Introduction
Welcome to Jersium.
Jersium is a multi-vendor marketplace and interactive platform for eligible physical products, collecting, Jersey Catalogue tools, digital collection features, E-VER, digital rewards, community features, and related services.
These Terms of Service govern your access to and use of Jersium. By accessing or using Jersium, creating an account, browsing the platform, making a purchase, selling a Product, submitting content, using E-VER, claiming digital rewards, or using any Jersium feature, you agree to these Terms of Service and the other Platform Policies that apply to the relevant feature.
If you do not agree to these Terms of Service, you must not use Jersium.
2. Who operates Jersium
Jersium is operated by:
TimChief Ventures P.S.A. Meteorologów 13/29 40-526 Katowice Poland
Company Number (KRS): 0001077591 NIP: 9542863191 VAT No.: PL9542863191 Email: [email protected]
In these Terms, "Jersium", "we", "us", and "our" refer to TimChief Ventures P.S.A. operating the Jersium platform.
3. Jersium's Terms & Conditions and Platform information
Jersium's Terms & Conditions include these Terms of Service and the Platform Policies and Platform information that apply to the relevant feature, transaction, role, or issue.
Feature-specific terms apply to the feature, transaction, role, or issue they cover. If these Terms of Service and a more specific Platform Policy differ, the more specific rule applies to that feature, transaction, role, or issue to the extent of the difference.
Information shown in checkout, listing creation, seller setup, E-VER submission, order pages, return flows, the Fee Table, the Regions page, the Condition Guide, or another relevant Platform area may set current values, deadlines, fees, eligibility requirements, operational rules, or feature-specific conditions for the action it relates to.
Help Centre content and Platform information may explain current rules, values, standards, fees, deadlines, eligibility requirements, or processes. They apply where they are referenced by the Terms & Conditions, shown in a relevant Platform flow, or used to describe a current Platform rule, value, standard, fee, deadline, eligibility requirement, or process.
For an Order, the transaction-specific listing and checkout information, fees, Seller-specific conditions, and transaction-specific deadlines applicable when the Order was placed remain the applicable version for that Order unless mandatory law requires otherwise, a later change is more favourable to the affected User, or a legal or safety intervention requires a different result.
Sellers may provide practical shop information and, in some cases, seller-specific conditions. A clear seller-specific promise or condition may form part of the contract between a Buyer and a Seller where it was visible before the Order was placed, applies to that transaction, is lawful and understandable, and does not conflict with the listing, checkout information, or Jersium's Platform Policies. Seller information can never reduce mandatory buyer rights or Jersium Buyer Protection, replace or modify any part of Jersium's Terms & Conditions or Platform procedures (including payment, refund, return, and dispute procedures), contradict the listing or checkout, impose obligations on Jersium, or amend the separate contract between Jersium and any user.
The order of priority is: mandatory applicable law, then the transaction-specific listing and checkout information, then Jersium's applicable Platform Policies, then permitted seller-specific conditions. A Seller promise giving a Buyer additional or more favourable rights does not conflict merely because it is more generous. If a Jersium provision is invalid, unfair, or unenforceable, the consequence is determined by applicable law; a Seller condition does not automatically replace it. Detailed rules are set out in the Seller Terms.
Mandatory rights and obligations under applicable law always prevail where they cannot be excluded or limited.

5. Eligibility
You must be at least 18 years old to create an Account or use transactional features on Jersium.
By creating an Account, making a purchase, selling a Product, submitting an E-VER request, claiming a Digital Reward, or using restricted Jersium features, you confirm that you are at least 18 years old and have legal capacity to enter into binding agreements.
Jersium may restrict, suspend, or refuse access where we believe a person is underage, lacks legal capacity, provides inaccurate information, uses the Platform unlawfully, or creates a risk to users, Jersium, or the Platform.
6. Accounts
Some Jersium features are available without an Account. Other features require registration.
You may need an Account to sell Products, access your Digital Collection, submit E-VER requests, claim Digital Rewards, post photos, videos, comments, or forum content, use social and community features, save preferences, create collection goals, use watchlists or price alerts, manage marketplace transactions, or use seller tools.
You must provide accurate, complete, and current information when creating and using your Account, and you are responsible for keeping your Account information up to date.
7. Guest access
Guests may browse parts of Jersium and may be able to make purchases where guest checkout is available.
Guests cannot access all Jersium features. Features such as selling, Digital Collection, E-VER account vouchers, digital rewards, profile features, social features, forums, photos, videos, friends, collection goals, price alerts, and similar account-based tools may require a registered Account.
Guest purchases are subject to the Platform Policies and checkout information that apply to the purchase. Guests may use Jersium's order-related messaging, problem reporting, dispute communication, and Buyer Protection tools without creating an Account; access may require secure verification through the email address or order details connected to the purchase. Guests may need to use a guest order portal, email verification, order-access link, or support process to manage an Order, submit evidence, or receive notices, as described in the Buyer Terms & Buyer Protection Policy.
Guest purchases may not be eligible for certain account-based features, including automatic Digital Collection imports, unless Jersium expressly makes those features available.
8. Account types
Jersium may offer different Account types, including Personal Accounts, Commercial Accounts, Fulfillment Team sub-user accounts, admin or internal accounts, and other account types introduced by Jersium.
A Personal Account may be used for buying, private selling where available, and community features. Buying on Jersium is intended for consumers, and a Personal Account must not be used for purchases connected with a trade, business, craft, or profession.
Commercial Accounts cannot make purchases on Jersium. Consumer-specific rights apply where the Buyer qualifies as a consumer under applicable law.
A Commercial Account is used by businesses, traders, professional sellers, or other commercial operators. Commercial Accounts may be subject to additional verification, seller information duties, tax information, business documentation, product safety obligations, and regional rules.
Jersium may decide which Account types are available in each region and may roll out Account types gradually.
9. One account rule
Unless Jersium expressly allows otherwise, each person may hold only one Personal Account.
Commercial Sellers may be able to create or manage additional authorised access through Fulfillment Team sub-users or other tools made available by Jersium.
You must not create multiple accounts to avoid restrictions, manipulate Marketplace Performance, obtain rewards, misuse referrals, bypass purchase or selling limits, avoid enforcement, or interfere with the Platform.
Jersium may merge, restrict, suspend, or close accounts where we detect duplicate, abusive, fraudulent, or unauthorised account activity.
10. Fulfillment Team access
Commercial Sellers may be able to create limited-access Fulfillment Team sub-users for order-related tasks. The main Commercial Seller account holder is responsible for all actions taken by their Fulfillment Team sub-users.
Detailed Fulfillment Team access, credential, data-use, and responsibility rules are set out in the Seller Terms.
11. Account verification
Jersium may require verification for certain features, including account security, seller setup, commercial selling, receiving payouts, updating sensitive information, preventing fraud, complying with legal obligations, or protecting the Platform.
Verification may include email verification, phone verification, identity verification, business verification, beneficial-owner information, document checks, payment-provider checks, sanctions screening, or other checks made available through Jersium or its verification partners.
Jersium may refuse, restrict, delay, or suspend access to features where verification is incomplete, unsuccessful, expired, inconsistent, or raises compliance, fraud, security, or platform-integrity concerns.
Providing false, misleading, manipulated, incomplete, or unauthorised verification information may result in loss of access to features, cancellation of seller privileges, account restrictions, or account closure.
12. Account security
You are responsible for keeping your Account secure. You must use accurate registration information, keep your login details confidential, not share your password, use available security features responsibly, notify Jersium if you suspect unauthorised access, and not allow unauthorised persons to use your Account.
Jersium may require additional authentication, verification codes, two-factor authentication, password resets, email confirmation, phone confirmation, or other security steps where necessary.
Jersium is not responsible for losses caused by your failure to protect your Account, except where liability cannot be excluded by law.
13. Regional availability
Jersium may make features, services, account types, marketplace activity, digital services, digital rewards, payment methods, currencies, shipping routes, and other Platform functions available only in supported regions or for supported users, transactions, account types, or product categories.
Current regional availability is shown on the Platform, including in the Regions page, seller setup flow, checkout flow, Help Centre, or other relevant Platform information.
Marketplace-specific rules for marketplace regions, currencies, search visibility, ship-to destinations, selling eligibility, purchasing eligibility, and checkout eligibility are governed by the Marketplace Terms and relevant Platform information.
Jersium may add, remove, suspend, restrict, or modify regional availability where necessary or useful for operational, legal, tax, payment, shipping, product safety, compliance, security, or business reasons.
14. Platform services
Jersium may provide, among other things:
- marketplace features for eligible physical products and related marketplace services;
- account, profile, Jersey Catalogue, collection, search, communication, review, community, and other interactive features;
- E-VER, Digital Collection, Digital Rewards, and other digital or platform features; and
- Jersium-provided products, services, vouchers, digital items, rewards, or other platform benefits made available from time to time.
Specific services may be subject to separate Platform Policies or feature-specific terms.
Jersium may change, improve, restrict, suspend, discontinue, or replace services or features where necessary for operational, legal, technical, safety, security, compliance, or business reasons.
15. Marketplace role
Jersium provides marketplace services that help Buyers and Sellers connect, list Products, purchase Products and other Items, process payments, manage orders, support shipping, use Buyer Protection, and resolve disputes.
Unless expressly stated otherwise, the sales contract for a Product is between the Buyer and the Seller. Jersium is not the seller, importer, or fulfilment service provider of Products listed by third-party Sellers, and the Seller is responsible for the Product, including product liability where applicable. Every listing, checkout, order confirmation, and invoice identifies the third-party Seller.
Jersium may also provide or sell Jersium-provided products, services, digital features, vouchers, rewards, profile features, or other platform benefits where made available through the Platform. Where Jersium is the seller or service provider, this will be shown or governed by the applicable checkout terms or Platform Policy.
16. Payments and payment methods
Marketplace payment processing, available payment methods, payment authentication, payment refusal, saved payment methods, refunds, chargebacks, and payment-provider rules are governed by the Marketplace Terms, checkout flow, Fee Table, payment-provider rules, and applicable Platform information.
Payments are processed by one or more licensed or authorised third-party payment service providers and their banking and settlement partners. Funds are held and transferred by those providers and partners and are not held in Jersium's own accounts. Jersium may change payment service providers at any time.
Jersium does not charge Buyers a marketplace fee. Seller-side fees are set out in the Fee Table and the Seller Terms.
Digital services, Jersium Store Items, vouchers, digital products, and other non-marketplace purchases may have payment rules and charges shown in the relevant checkout flow or applicable feature terms.
All prices, fees, taxes, and charges that Jersium is required to display before purchase will be shown at checkout or in the relevant Platform area.
17. Currency and regional transaction rules
Currency, marketplace search visibility, checkout eligibility, shipping routes, selling availability, and purchasing availability may depend on Seller region, Buyer location, selected ship-to destination, Platform settings, payment-provider availability, tax rules, product safety rules, and applicable law.
Marketplace-specific currency and regional transaction rules are governed by the Marketplace Terms, Regions page, checkout flow, seller setup flow, currency settings, and other relevant Platform information.
Users may only use the regions, currencies, shipping routes, payment methods, and transaction flows made available to them by Jersium.
18. Product Data Index, product data, and sample images
Jersium operates the Product Data Index and related product-data systems that may be used for marketplace listings, search, Digital Collection, E-VER, collection goals, price history, rarity indicators, and other Platform features.
Products may need to be indexed, classified, imaged, reviewed, or released by Jersium before they can be listed for sale or used in certain Platform features.
Sample images are provided for product identification and informational purposes only. Seller photos show the actual Product offered for sale.
Detailed Product Data, sample-image, rarity, correction, data-use, and permitted-use rules are governed by the Product Data Rules and the Marketplace Terms.
19. Rarity and informational indicators
Jersium may display rarity labels, Product Data classifications, edition labels, version labels, sample images, statistics, price history, Marketplace Performance, and other informational indicators for Products, Digital Collection items, digital reward items, and other Platform content.
These indicators are informational Platform classifications. They are not guarantees of authenticity, market value, investment performance, future resale price, liquidity, scarcity in the entire market, or availability unless Jersium expressly states otherwise.
Detailed rarity, Product Data, price-history, sample-image, digital-product, and informational-indicator rules are governed by the Product Data Rules and the applicable Platform information.
20. Digital Collection, E-VER, and digital rewards
Jersium may offer Digital Collection features, E-VER external-item import flows, automatic Digital Collection imports after eligible Jersium purchases, JMS digital jerseys, reward-issued digital items, backgrounds, skins, badges, profile items, and other digital rewards, digital services, or digital features.
Unless Jersium expressly states otherwise, digital collection entries, digital reward items, reward-issued digital jerseys, backgrounds, skins, badges, and similar digital features are platform-only digital features for personal enjoyment, profile display, collecting, platform engagement, or community participation. They do not represent ownership of a physical product, have no cash value, are not redeemable for money, and are not financial or investment products.
Detailed rules for E-VER, Digital Collection imports, digital services, vouchers, Digital Rewards, JMS, badges, cosmetic profile features, and related digital features are governed by the Digital Services Terms, Digital Rewards Terms, checkout flow, and Platform information.
21. Jersium's intellectual property and your licence to use the Platform
Jersium and its licensors own all rights in the Platform and its content, including the Jersium name, logos, trademarks, brand elements, software, source code, databases, page and interface design, layout, graphics, illustrations, product mockups, sample images created or commissioned by Jersium, Jersey Catalogue presentation, Product Data Index structure, digital jersey and JMS artwork, badge and reward designs, text, help content, and other materials made available by Jersium.
Jersium grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Platform for its intended purposes in accordance with the Terms & Conditions. This right ends if your Account is closed or your access is withdrawn.
Except as permitted by the Terms & Conditions, by a Platform feature, or by mandatory law, you must not copy, reproduce, publish, distribute, sell, licence, sublicence, rent, adapt, modify, translate, decompile, reverse engineer, frame, mirror, or create derivative works from the Platform or its content; remove or alter any notice, watermark, label, or attribution; use Jersium's trademarks, brand elements, or design in a way that suggests affiliation, endorsement, or authorisation that does not exist; or use automated tools, scripts, bots, crawlers, scrapers, or similar methods to access, extract, monitor, copy, or re-use the Platform, Product Data, listings, prices, images, user content, or other Platform data.
Jersium claims and reserves all database rights, sui generis database rights, and equivalent protections in the Product Data Index, the Jersey Catalogue, Product Data Entries, price-history data, rarity data, aggregated marketplace data, and other Jersium databases. You must not extract or re-utilise all or a substantial part of those databases, or repeatedly extract or re-utilise insubstantial parts in a way that conflicts with Jersium's normal exploitation of them. Detailed permitted-use rules for Product Data are set out in the Product Data Rules.
Rights in User Content remain with the User who submitted it, and are governed by the User Content Rules.
Nothing in this section limits any right you have under applicable law that cannot be excluded by contract, including permitted uses under copyright, database, or competition law.
22. User Content
Users may be able to submit, upload, post, display, send, suggest, or otherwise make available User Content through Jersium.
You are responsible for your User Content. You must not submit User Content that is illegal, infringing, promotes or facilitates counterfeit goods, is fabricated or falsified where genuine material is required, deceptive, misleading, abusive, discriminatory, harassing, pornographic, violent, fraudulent, spam, privacy-infringing, or otherwise prohibited by the Platform Policies.
Detailed rules for User Content, content visibility, content licences, Product and Collection Materials, seller listing photos, E-VER materials, community photos and videos, reviews, ratings, User Chat, Marketplace Chat, moderation, moderation notices, review of moderation decisions, reporting, and prohibited content are governed by the User Content Rules, which are the primary home for those rules.
23. Communications, chats, and automatic translation
Jersium may provide User Chat, Marketplace Chat, support messages, report messages, return messages, dispute messages, and other communication features for marketplace, community, support, or account-related purposes.
Users must not use any Jersium communication feature to avoid Jersium fees, move transactions off-platform, harass users, send illegal or prohibited content, or misuse the Platform. Detailed communication, content, monitoring, moderation, and prohibited-content rules are governed by the User Content Rules; transaction-specific chat rules are governed by the Marketplace Terms.
Jersium may offer automatic translation for chats, marketplace communications, user-generated content, support interactions, or other platform content. Automatic translations are provided for convenience and may not be perfect, complete, or legally precise. Where original wording is relevant to a dispute, moderation decision, legal issue, or transaction, Jersium may consider the original content, translated content, surrounding context, and available evidence. Automatic translation may involve internal systems or third-party providers and is subject to the Privacy Policy.
Where seller information is translated for a Buyer, Jersium stores both the Seller's original-language version and the translated version presented to the Buyer, together with the version applicable at the time of purchase.
24. Marketplace Performance, reviews, and transaction feedback
Jersium may allow Users to submit reviews, ratings, comments, or transaction feedback after eligible marketplace transactions and may generate automatic transaction feedback where Platform rules allow it.
Marketplace Performance is not necessarily a pure user-review average and may include automatic transaction feedback or other factors described in the Ratings & Reviews information.
Detailed rules for reviews, ratings, automatic feedback, review manipulation, highlighted reviews, Marketplace Performance, and review-related enforcement are governed by the User Content Rules, the Ratings & Reviews information, and the Marketplace Terms.
25. Product safety and illegal goods
Users must not use Jersium to list, offer, sell, buy, upload, promote, request, disguise, or facilitate illegal, unsafe, counterfeit, recalled, prohibited, deceptive, or non-compliant Products or content.
Detailed product safety, illegal-goods, counterfeit, lawful-sourcing, labelling, Responsible Person, warning, recall, customs, carrier, product-compliance, and seller-compliance rules are governed by the Product Safety & Illegal Goods Policy, Seller Terms, Marketplace Terms, IP, Copyright & Counterfeit Reporting Policy, Condition Guide, and relevant Platform information.
26. Reporting, moderation, and enforcement
Jersium may provide reporting channels for legal, safety, marketplace, content, Product Data, privacy, accessibility, support, fraud, technical, or platform-integrity issues. Current reporting channels are shown in the Legal area, Help Centre, and relevant Platform flows.
Jersium may review reports, request additional information, temporarily restrict or remove content, deactivate listings, restrict content, communication, interaction, marketplace, account, or other features, suspend selling privileges, limit accounts, close accounts, or take another action permitted by the applicable Platform Policies and law.
Where Jersium takes a Moderation Action, notice is given unless Jersium is legally prevented from doing so or notification can lawfully be omitted, and a review route is provided where applicable, as described in the User Content Rules. Where required or appropriate, Jersium may provide reasons, allow responses or appeals, preserve records, notify affected users, or cooperate with authorities.
27. Fraud prevention and platform integrity
This section is the primary home for Jersium's fraud-prevention and platform-integrity rules. Other Platform Policies describe the role-specific effect of these rules for a particular feature, transaction, or account type.
Jersium may use manual and automated checks to prevent, detect, investigate, and respond to fraud, payment abuse, chargeback abuse, counterfeit activity, account misuse, duplicate-account abuse, referral abuse, reward abuse, marketplace manipulation, review manipulation, off-platform dealing, suspicious transactions, security risks, and violations of Platform Policies.
These checks may use account information, verification information, transaction information, payment status, shipment information, listing information, proof submissions, E-VER materials, User Content, Marketplace Chats, reports, support records, device and technical signals, and other information available to Jersium.
Jersium may delay, restrict, cancel, or review transactions, payments, payouts, listings, accounts, or features where risk checks raise concerns, and may request additional information from a Buyer, Seller, Guest, or User where necessary to verify identity, transaction legitimacy, shipping information, payment information, product compliance, or account security.
Jersium is not required to disclose detailed fraud rules, risk signals, comparison logic, security logic, or internal criteria where disclosure could compromise safety, security, fraud prevention, counterfeit detection, legal compliance, or Platform integrity. Where applicable law gives a right to human review of, or an explanation about, an automated decision, Jersium will provide the safeguards required by that law.
Personal data processing for fraud prevention, security, and platform integrity is described in the Privacy Policy.
28. Prohibited conduct
You must not:
- use Jersium unlawfully;
- provide false, misleading, incomplete, manipulated, or fraudulent information;
- sell counterfeit, stolen, unsafe, recalled, illegal, or prohibited goods;
- misrepresent product condition, authenticity, origin, version, edition, provenance, autograph status, player-issued status, or other material facts;
- upload manipulated, misleading, reused, or AI-generated proof where authentic proof is required;
- move or attempt to move marketplace transactions off Jersium, or propose doing so;

- scrape, copy, extract, re-utilise, reverse engineer, or misuse platform data or the Product Data Index except as permitted elsewhere in these Terms or by law;
- infringe intellectual property, privacy, publicity, or other rights; or
- violate any Platform Policy.
29. Account restrictions, suspension, and closure
Jersium may restrict, suspend, or close your Account or access to specific features where necessary to protect users, enforce Platform Policies, comply with law, prevent fraud, prevent abuse, manage risk, protect payment or marketplace integrity, or maintain the Platform.
Actions may include warnings; cart updates, checkout blocking, payment refusal, or purchase restrictions; restriction or suspension of buying privileges; content removal; restriction of content, communication, and interaction features, including upload, posting, commenting, forum, photo/video, messaging, User Chat, Marketplace Chat, review, rating, report, profile, Digital Collection, or other interactive features; listing deactivation; loss of E-VER privileges; loss of digital reward eligibility; loss of Buyer Protection where misuse occurs; review restrictions; selling restrictions or suspension of selling privileges; payout delays or holds where permitted; account restrictions; account suspension; and account closure.
Where an action is a moderation action, the notice and review rules in the User Content Rules apply. Where an action affects a Commercial Seller's use of seller features, the Seller Terms also apply.
30. Account deletion
You may request deletion of your Account through My Account → Delete Account, subject to outstanding orders, unresolved disputes, legal obligations, fraud-prevention needs, tax and accounting obligations, security requirements, and retention rules described in the Privacy Policy. If you cannot access your Account, use Jersium's login-recovery or login-support process.
If you have outstanding orders, unresolved disputes, active investigations, unpaid fees, negative balances, open payouts, chargeback issues, or other unresolved marketplace obligations, Jersium may delay Account deletion until those matters are resolved.
Deleting your Account may permanently remove or disable access to your profile, Digital Collection, collection goals, badges, rewards, social content, settings, and other account-based features, subject to legal retention and backup rules.
Certain content or records may remain where necessary for legal compliance, dispute handling, fraud prevention, tax and accounting purposes, safety, security, legitimate business records, or where content has been shared publicly and is not required to be removed by law.
31. Platform availability
Jersium aims to provide a reliable platform but does not guarantee uninterrupted, error-free, or continuously available access.
Jersium may suspend, limit, change, or interrupt access for maintenance, upgrades, security, technical issues, legal compliance, provider issues, payment-provider issues, hosting issues, fraud prevention, emergencies, or other operational reasons.
Jersium may display maintenance notices where reasonably possible but is not required to provide advance notice for urgent or unexpected issues.
32. Technical requirements
To use Jersium, you need a device, internet access, and a supported browser or app environment.
Some features may require cookies, JavaScript, email access, phone verification, file uploads, camera access, location or address information, payment authentication, or other technical requirements.
Jersium may not work properly on outdated browsers, unsupported systems, blocked cookies, disabled scripts, restricted devices, or unstable internet connections.
33. Accessibility
Jersium aims to make the Platform accessible and usable for as many people as possible.
Accessibility details, current standards, known limitations, ongoing improvements, and contact information are set out in the Accessibility Statement.
User-generated content may not always meet the same accessibility standards as platform-controlled content.
34. Privacy and cookies
Jersium processes personal data in accordance with the Privacy Policy, and uses cookies and similar technologies in accordance with the Cookie Policy and the cookie choices made available on the Platform.
The Privacy Policy explains how Jersium processes account data, profile data, transaction data, seller verification data, payment and payout data, chats, support messages, E-VER submissions, User Content, dispute evidence, translation data, tracking data, tax-related data, cookie data, and other personal data.
35. Sanctions and trade controls
Jersium, its payment providers, and its service providers are subject to economic sanctions, export controls, and trade-restriction rules, including those of the European Union, the United Kingdom, the United States, and other applicable regimes.
By using Jersium, you represent and warrant that you are not, and are not owned or controlled by or acting on behalf of, a person or entity listed on any sanctions list of the European Union, the United Nations, the United Kingdom, or the United States, including the OFAC Specially Designated Nationals (SDN) List; that you are not located, established, organised, or resident in any country or territory that is the subject of comprehensive sanctions or embargoes; and that you will not use Jersium to offer, sell, buy, ship, or make a Product, payment, payout, or service available to or from such a person, entity, country, or territory.
Registration, checkout, and ship-to and ship-from destinations are blocked for territories subject to comprehensive sanctions. The list of restricted territories is maintained by reference to the applicable sanctions regimes and may be updated at any time without notice.
Jersium may screen Users, Sellers, Buyers, payout recipients, representatives, and beneficial owners against applicable sanctions lists before and during your use of the Platform, and may re-screen periodically. Where a screening result, transaction, destination, or payment raises a sanctions, export-control, or trade-restriction concern, Jersium may refuse or cancel a transaction, block checkout, restrict ship-to destinations, withhold or freeze funds or payouts, request further information, restrict or close the Account, and make any report required by applicable law.
Jersium may take these steps without prior notice where required by law, may be prevented by law from explaining the reason for a specific action, and accepts no liability for action reasonably taken for sanctions compliance, except where liability cannot be excluded by law.
36. Changes to Jersium and the Terms & Conditions
This section is the primary home for how Jersium changes the Terms & Conditions and gives notice of changes. Other Platform Policies refer to this section rather than setting their own notice mechanism.
Jersium may change, update, suspend, remove, or modify features, services, Platform information, operational limits, eligibility rules, fee structures, supported regions, supported currencies, shipping routes, seller status criteria, Marketplace Performance rules, and other Platform rules from time to time.
Where Jersium makes a change to the Terms & Conditions or to fees that adversely affects you, Jersium will give at least 15 days' notice before the change takes effect — or the longer notice applicable law requires for the specific change — by email, Platform notification, account notice, or another appropriate method. This notice period does not apply where the change is required by law or a regulator, is needed to address a security, fraud, or safety risk, relates to the introduction of a new optional feature or service, or is otherwise more favourable to you; and it does not apply where you have expressly waived the notice period in a case permitted by applicable law.
Where a change requires business users to make technical or commercial adaptations to their listings, integrations, or operations, Jersium provides a proportionately longer notice period reflecting the adaptation reasonably required.
If you do not agree to a change, you may close your Account or stop using the affected feature before the change takes effect. Continued use of Jersium after a change takes effect means you accept the updated Terms & Conditions, where acceptance by continued use is permitted by applicable law. Outstanding obligations continue to apply.
Jersium may publish current operational information, limits, eligibility rules, supported regions, supported currencies, shipping deadlines, fee amounts, seller status criteria, product eligibility rules, and feature availability in the relevant Platform area, Fee Table, Help Centre, Regions page, seller setup flow, checkout flow, or other Platform information. Where these Terms & Conditions refer to information shown on the Platform, the current Platform information applies unless these Terms & Conditions or mandatory law require otherwise. Transaction-specific information already fixed for an existing Order remains governed by the rule in section 3.
37. Language versions
Jersium may provide these Terms of Service and other Terms & Conditions in more than one language.
Where a mandatory local-language rule applies, including for consumers in Poland, the language version required by that rule applies, and Jersium will not rely on a translation inconsistency to a consumer's disadvantage.
Otherwise, the English version prevails if there is a conflict between language versions.
38. Notices and contact points

Personal data processing involving third-party providers is described in the Privacy Policy.
40. Limitation of liability
Jersium provides the Platform with reasonable care and skill, but the Platform may not always be available, error-free, complete, current, or suitable for every purpose.
To the fullest extent permitted by applicable law, Jersium is not liable for indirect, incidental, special, consequential, punitive, or unforeseeable losses, including loss of profits, loss of revenue, loss of business, loss of anticipated savings, loss of data, loss of goodwill, or loss of opportunity.

Cap for business users. If you use Jersium in the course of a business, trade, or profession, including as a Commercial Seller, Jersium's total aggregate liability to you arising out of or in connection with the Terms & Conditions and your use of the Platform, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited, per 12-month period, to the greater of (a) the total fees you paid to Jersium in the 12 months before the event giving rise to the liability, and (b) EUR 500 / GBP 500 / USD 500, using the figure that corresponds to your transaction currency (or the closest equivalent for any other currency Jersium may support).
What is never limited. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by applicable law, including liability for death or personal injury caused by negligence, intentional misconduct, gross negligence where applicable, fraud or fraudulent misrepresentation, and mandatory consumer rights. The cap for business users does not apply to those matters.
Consumers and consumer-equivalent users. If you are a consumer, the cap for business users does not apply to you, and nothing in this section affects your statutory rights, your rights against a Seller, or Jersium Buyer Protection. The cap for business users also does not apply to any person entitled to consumer or consumer-equivalent protection under applicable law, including a natural person conducting business activity who enters into a contract with Jersium that is not of a professional character for them.
41. Force majeure
Neither you nor Jersium is liable for a failure or delay in performing an obligation under the Terms & Conditions that is caused by an event beyond that party's reasonable control, including natural disaster, extreme weather, fire, flood, epidemic or pandemic, war, civil unrest, terrorism, sabotage, strike or industrial action, government or regulatory action, sanctions, embargo, customs or border disruption, carrier failure, failure of a payment provider, bank, or clearing system, internet, hosting, telecommunications, or power failure, and cyber-attack.
The affected party must inform the other party where reasonably possible and take reasonable steps to limit the effect. Where the event continues for a prolonged period, either party may end the affected obligation or the relevant part of the agreement where permitted by applicable law.
This section does not affect a Buyer's rights on non-delivery, a refund obligation, a payment obligation that has already fallen due, or any mandatory legal right.
42. Indemnity
Where permitted by law, you agree to compensate Jersium for losses, claims, damages, penalties, costs, expenses, and reasonable legal fees arising from:

- your fraud, misrepresentation, or abuse;
- your misuse of marketplace, payment, support, reporting, or communication systems; and

This clause does not limit any mandatory rights you may have as a consumer, and does not apply to a consumer except to the extent permitted by applicable law.
43. Governing law, mandatory rights, and jurisdiction
These Terms of Service are governed by Polish law, unless mandatory consumer protection, marketplace, privacy, product safety, or other applicable laws require otherwise.
Consumers. If you are a consumer, you may also have mandatory rights under the laws of your country, state, or region of residence, and you keep the right to bring proceedings in, and to be sued only in, the courts available to you under applicable law. Nothing in these Terms of Service or any Platform Policy limits rights that cannot be waived or excluded by contract.
Business users. If you use Jersium in the course of a business, trade, or profession, including as a Commercial Seller, the courts competent for Katowice, Poland have exclusive jurisdiction over disputes arising out of or in connection with these Terms of Service and the Platform Policies, unless mandatory law provides otherwise.
This exclusive jurisdiction clause does not apply to a consumer, and does not apply to any person entitled to consumer or consumer-equivalent protection under applicable law, including a natural person conducting business activity who enters into a contract with Jersium that is not of a professional character for them.
Regional consumer-rights information may be set out in the Buyer Terms & Buyer Protection Policy, Marketplace Terms, Digital Services Terms, Privacy Policy, Cookie Policy, or other applicable Platform Policies.
44. Dispute resolution
If you have an issue with Jersium, another User, a transaction, a listing, a payment, a delivery, a digital service, or platform content, you should use the relevant support, dispute, reporting, or appeal process made available on the Platform.
Marketplace disputes between Buyers and Sellers are handled under the Buyer Terms & Buyer Protection Policy, Seller Terms, and Marketplace Terms. Complaints about moderation decisions are handled under the User Content Rules, which also explain any additional complaint-handling or out-of-court dispute settlement rights where applicable law provides them.
Consumer alternative dispute resolution. Jersium participates in consumer alternative dispute resolution (ADR) only where participation is required by law. For consumers in Poland, the competent ADR entity is the Trade Inspection (Inspekcja Handlowa), through the provincial inspectorate competent for the consumer's place of residence or for Jersium's registered office. Consumers in other EU member states may contact the ADR entity competent for them, and may obtain information about available entities from their national consumer authority or European Consumer Centre. Complaints about content moderation decisions are handled under the User Content Rules.
Nothing in the Platform Policies prevents you from using mandatory legal remedies, consumer rights, regulator complaints, court rights, out-of-court dispute settlement, or other rights that cannot be waived by contract.
45. Entire agreement
These Terms of Service, together with the Platform Policies and Platform information they refer to, form the entire agreement between you and Jersium regarding the Platform and replace any earlier agreements, communications, or statements about the Platform.
Nothing in this clause limits or excludes liability for fraud or fraudulent misrepresentation, or any rights that cannot be excluded by law.
46. Severability
If any part of these Terms of Service is found to be invalid, unlawful, or unenforceable, the remaining parts continue to apply.
Where possible, the invalid or unenforceable part will be interpreted or replaced in a way that best reflects its original purpose while remaining lawful.
47. No waiver
If Jersium does not immediately enforce a right or rule, that does not mean Jersium waives that right or rule.
Any waiver must be explicit and in writing.
48. Assignment
You may not transfer your rights or obligations under these Terms of Service without Jersium's prior written consent.
Jersium may transfer its rights or obligations where permitted by law, including in connection with a merger, restructuring, sale, transfer of business, corporate change, or operational change. Where required, Jersium will give notice as described in the changes section of these Terms.

This includes clauses relating to outstanding transactions, fees, negative balances, refunds, chargebacks, disputes, User Content, intellectual property, privacy, product safety, fraud prevention, sanctions, enforcement, liability, indemnity, jurisdiction, and legal compliance.
